
Telus I Want a Blackberry Contest (“Contest”)
This Contest Is Open to Canadian Residents Only and Is Governed by Canadian Law.Eligibility:
Contest is open to residents of Canada only who are at least 13 years of age and full-time students at the time of entry, except employees (and those with whom they are domiciled) of TELUS Corporation, its affiliated companies, entities or subsidiaries (“Sponsor"), its representatives, dealers and agents, and advertising and promotional agencies.
How to Enter:
No purchase necessary. Contest begins on or around August 5, 2009 at 12:00:01 Eastern Time (EST) and ends on September 15, 2009 at 11:59:59 EST (the “Contest Period”). Two ways to enter for a chance to win: (i) Go to TELUSmobility.com/iwantablackberry or TELUS.com/iwantablackberry or the TELUS student Facebook fan page on Facebook.com/TELUSstudent (the “Websites”), click on the “enter” button and an Entry form will appear. Complete the Entry form on the Websites (which requires your first name, last name, email address and telephone number) to nominate yourself for a chance to win a Grand Prize (“Contest Entry”); (ii) Vote for yourself or another entrant to receive the opportunity to enter into the random draw prize award (“Random Draw Entry”) (individually an “Entry” and collectively “Entries”).
Limit of one (1) Contest Entry and one (1) Random Draw Entry per person/email address permitted during the Contest Period. If it is discovered that you attempted to enter more than one (1) Contest Entry and/or one (1) Random Draw Entry during the Contest Period, then all your Entries will be void. Entries will be rejected if the Entry form is not fully completed and submitted during the Contest Period. Without limitation, the Sponsor and its advertising and promotional agencies are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries.
By participating in the Contest, each entrant agrees to be bound by these Contest Rules (the “Rules”) and by the interpretation of these Rules by the Sponsor.
By entering the Contest and submitting an Entry, each entrant or, if the entrant is under the age of majority, his/her parent or legal guardian: (i) confirms compliance with Contest Rules; (ii) grants to the Sponsor, in perpetuity, a non-exclusive licence to publish, display, reproduce, modify, edit or otherwise use the Entry (and any other related information provided with the Entry) in whole or in part on the Websites and/or for advertising or promoting the Contest or for any other reason; and (iii) agrees to release and hold harmless the Sponsor and its advertising and promotional agencies and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual-property-related cause of action. For greater certainty, the Sponsor reserves the right, in its sole discretion, to modify, edit or remove any Entry or other identification information provided with the Entry, or to require an entrant to modify or edit his/her Entry, if a complaint is received with respect to the Entry, or for any other reason.
Random Draw Prizes:
There will be twenty-five (25) Random Draw Prizes awarded, each consisting of a BlackBerry® Curve™ 8330 and one (1) year on the Student 35 BlackBerry® Plan for free (TOTAL ARV = $1,064.99: $615.00 for one (1) year service plan [which includes applicable taxes] and $449.99 for BlackBerry® Curve™ 8330). The random draw will be conducted from all eligible Random Draw Entry forms received during the Contest Period.
Grand Prizes:
There will be seventy-five (75) Grand Prizes awarded to the 75 Entrants who received the most votes during the Contest Period, each consisting of a BlackBerry® Curve™ 8330 and one (1) year on the Student 35 BlackBerry® Plan for free (TOTAL ARV = $1,064.99: $615.00 for one (1) year service plan [which includes applicable taxes] and $449.99 for BlackBerry® Curve™ 8330).

All other costs incurred over and above those included in the plan are the responsibility of the winner. TELUS reserves the right to modify the plan without notice. The winner will not be responsible for any swap fee or activation fee associated with their prize.
If the winner terminates their services before the end of the one-year period, any credits available for the remaining months will be cancelled.
Prize does not include activation and all activations are subject to a credit check and the TELUS Service Terms.
Prizes must be accepted as awarded. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value. Maximum of one (1) Random Draw Entry Prize/Grand Prize per person/email address permitted during the Contest Period. Prizes will only be awarded to the person whose name and email address appears on the Entry and who can provide proof of full-time student status through a matching school ID.
Voting, Random Draw and Grand Prize Winner Selection Process:
Each day during the Contest Period, eligible members of the public with access to Facebook may vote for their favourite Entry posted on the Websites. Entrants can vote for themselves. Voting Entrants can also switch their vote during a given day, provided that only the last vote received on a given day of the Contest Period (based on EST) will be eligible. If it is discovered that attempts were made to vote more than once by the same person/email address per day, then all votes associated with that person/email address will be void. Use of any automated, script, macro or robotic program to submit votes may result in the disqualification, in the sole discretion of the Sponsor, of the Contest Entry to which such votes relate. After voting, if not already entered into the Contest and Random Draw Entry, each eligible voter will be given the option of entering the Random Draw Entry and Contest by completing the Random Draw Entry form and opting into the Contest. Maximum one (1) Contest and Random Entry per person/email address during the Contest Period.
Grand Prize Winners:
Immediately after the Contest Period, the seventy-five (75) Contest Entries who received the most votes will be deemed to be eligible for the Grand Prizes. In the event of a tie between two (2) or more Contest Entries, the Sponsor will conduct a random draw from among such tied Contest Entries to determine the 75th winner. Odds of winning depend on the number of entries, voting and other activities undertaken by entrants, as part of the Contest.
The selected entrants for the Grand Prize will be contacted by phone or email within five (5) business days of selection. If you have not been contacted by this date, you may assume that you are not the selected entrant.
Random Draw Prize Winners:
On September 16, 2009 (the “Selection Date”) on or about 3:00 p.m. EST, twenty-five (25) Random Draw Prize draws will be made by the Sponsor’s promotional agency or an employee of the Sponsor at Sponsor’s head office location in Scarborough, Ontario, from among all eligible Entries received during the Contest Period. The odds of being selected depend on the number of voting entries received. The Sponsor, will attempt to contact the selected entrant at the telephone number or email address provided on selected entrant’s Entry within five (5) business days of being selected. In the event that a selected entrant cannot be contacted within five (5) business days of being selected, he/she will be disqualified and an alternate selected entrant will be randomly drawn. Upon notification, the selected entrant must respond within two (2) business days by telephone to the contact number provided in the notification and the selected entrant’s response must be received by the Sponsor within two (2) business days of such notification. If the selected entrant does not respond in accordance with these Rules, he/she will be disqualified and will not receive a prize and another potential winner will be selected. Sponsors are not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for Sponsors to receive a selected entrant’s response. In order to be declared a winner of the Random Prize, the selected entrant must (i) correctly answer a time-limited mathematical skill-testing question; and (ii) the selected entrant or, if the selected entrant is under the age of majority, his/her parent or legal guardian will be required to sign and return within ten (10) days a full declaration of eligibility, and a release and indemnity form stating that he/she has read and understood these Contest Rules and grants all consents required for the Sponsor to broadcast, publish and disseminate his/her name, city and province/territory of residence, photograph and likeness, without compensation, in any future publicity carried out by the Sponsor in connection with this Contest, and releasing the Sponsor from all liability in connection with this Contest and the Prize, and consenting to the Sponsor’s use of his/her name and/or photograph.
Before being declared a GRAND PRIZE OR RANDOM DRAW PRIZE WINNER, each selected entrant or, if the winning entrant is under the age of majority, his/her parent or legal guardian must sign and return within ten (10) business days of notification a declaration and release prepared by the Sponsor, which, among other things: (i) confirms compliance with Contest Rules; (ii) agrees to indemnify the Sponsor, its advertising and promotional agencies and the contest judges against any and all claims, damages, liabilities, costs and expenses incurred in connection with: (a) the Contest and the selected entrant’s participation therein; (b) the selected entrant’s acceptance, use or misuse of a prize or any portion thereof; and/or (c) the use of the selected entrant’s Entry; and (iii) requires the selected entrant to correctly answer a time-limited mathematical skill-testing question. If a selected entrant: (a) cannot be contacted by phone or email within five (5) business days of selection; (b) fails to correctly answer the skill-testing question; or (c) fails to return the contest documents within thirty (30) days, then he/she will forfeit the prize and their opportunity to be a winner, and the next eligible entrant will be selected (based on the next highest number of votes received).
General Conditions:
No contact or correspondence will be entered into except with the winning entrants.
The Sponsor assumes no responsibility for lost, stolen, delayed, damaged or misdirected Entries or for any failure of the Websites, for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment, software, failure of any email or Entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from this Contest. The Sponsor reserves the right, at its sole discretion, to change, cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of TELUS and its advertising and promotional agencies, corrupt the security or proper administration of the contest or for any other reason. All Entries and votes are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with or unlawful in any way. Entries or votes submitted by unauthorised means or by spamming will be disqualified. In the event that it has been determined that an Entry has been made or vote cast in any manner not sanctioned by these Contest Rules and/or an entrant has submitted more than the number of entries permitted by these Contest Rules, the entrant and all of his/her entries and/or votes will be disqualified.
If a potential or declared winner is not in compliance with these Contest Rules, the Sponsor reserves the right to disqualify such entrant from the Contest and randomly select further entrants from the remaining eligible entries until a winner is finally declared.
By entering the Contest, each entrant agrees to the use of their name, address, voice, statements about the contest and/or photograph or other likeness, without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast and the Internet.
The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”), to withdraw or amend this Contest in any way in the event of an error, technical problem, computer virus, bug, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries.
In the event of a dispute, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted on the Entry form or associated with the vote Entry. “Authorized account holder” is defined as the person who is assigned an email address by an Internet provider, online service provider or other organization (business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected Entry.
The Sponsor, with the consent of the Régie, reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation in the event of any accident, printing, administrative or other error of any kind.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the contest and in accordance with Sponsor’s Privacy Policy (available at www.TELUS.com), unless the entrant otherwise agrees.
Entrants that are customers of TELUS at the time of entry and/or at the time of prize award must have their TELUS accounts in good standing (with a current account balance that is no more than thirty [30] days past due) in order to be eligible to win a prize.
