OFFICIAL RULES
Important: Please read these rules before entering this contest (the “Contest”).
By clicking on the “Accept” button or otherwise submitting any Entry Materials as defined below, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.
1. Eligibility. PURCHASE WILL NOT INCREASE ODDS OF WINNING. CONTEST VOID WHERE PROHIBITED. CONTEST OPEN ONLY TO RESIDENTS OF THE (50) FIFTY UNITED STATES AND DISTRICT OF COLUMBIA THAT ARE AT LEAST EIGHTEEN (18) YEARS OF AGE (OR THE AGE OF MAJORITY IN ENTRANT’S STATE OF RESIDENCE). IF YOU ARE NOT A RESIDENT OF THESE AREAS OR ARE UNDER THE AGE OF EIGHTEEN (18) (OR THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE), YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND SAFETY GLASSES USA, INC. (“SPONSOR”), RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU. To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers, and employees of Sponsor and any of their respective affiliates, subsidiaries, agents, professional advisors, agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply.
2. Disclaimer. Sponsor, all participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees, and agencies (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled, distorted, or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures; © any Contest disruptions, injuries, losses, or damages caused by events beyond the control of Sponsor or by unauthorized human intervention; or (d) any printing or typographical errors in any materials associated with the Contest.
3. a. Contest Period. The Contest starts at 9:00 AM (all times Eastern Standard Time) on October 1, 2009 and ends at 12:00 PM on November 2, 2009 (the “Contest Period”). All entries must be received during the Contest Period to be eligible to win a prize.

b. Voting Period. The Voting starts at 9:00 AM on October 5, 2009 and ends at 12:00 PM on November 8, 2009 (the “Voting Period”). All votes must be made during the Voting Period to be counted towards the winning entries. c. Winners Announcement. The three winners will be announced on November 9, 2009 on or after 9:00 AM.

4. Prizes. Prizes will be awarded as follows: The top three entries receiving the most votes at the end of the “Voting Period” will be determined the First Place Prize Winner, the Second Place Prize Winner, and the Third Place Prize Winner respectively. The First Place Prize Winner will receive a $100.00 gift certificate, the Second Place Prize Winner will receive a $50.00 gift certificate, and the Third Place Prize Winner will receive a $25.00 gift certificate. The gift certificates will be sent to the winning entrant via Email, and will be good for use at SafetyGlassesUSA.com towards merchandise, sales tax where applicable, and/or shipping costs. The gift certificate will be in the form of a One-Time Use Coupon Code that must be entered during the checkout process of an online order, or given to a customer service representative during a phone order. The gift certificates will have no cash value.

Odds of winning a prize depend on the number and quality of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. [All prizes will be awarded.] Prizes returned as undeliverable or otherwise not claimed within [ten (10)] days after delivery of notification will be forfeited [and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges of any prizes will be permitted. Limit one (1) prize per household or address.
In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
5. How to Enter. To enter, create or submit an original photograph depicting a costume or likeness wearing eyeprotection (“Photo”). (For example, your Photo might demonstrate you wearing your favorite pair of sunglasses and your Halloween costume.) Then, visit www.________________.com, complete the online Contest entry form (including, for example, by providing your e-mail address), and follow the directions to submit the Photo online in [.jpg or .png] formats (file size must not exceed _ () MB). Collaborative works will not be accepted. All requested information must be provided for your entry to be valid. By entering the Contest, you consent to being placed on an e-mail mailing list for promotional and other purposes. However, you may opt-out of receiving promotional e-mails from Sponsor upon receipt of the first e-mail by following the “unsubscribe” options contained therein.
6. Contest Rules. An entry into the Contest consists of your completed online Contest registration form and the Photo (together, the “Entry Materials”). Your Photo must be taken by, owned by, and/or originated by the entrant. Your Photo cannot contain inappropriate subject matter. The eyewear depicted in the Photo need not be a Safety Glasses USA product.
7. Sponsor License to Entry Materials. You hereby grant Sponsor a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to publish, reproduce, display, perform, distribute, adapt, edit, modify, translate, create derivative works based upon, and otherwise use and sublicense the Entry Materials, or any portion thereof, solely in connection with the Contest. You agree to take, at Sponsor’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect, or confirm Sponsor’s license rights as set forth in this paragraph.
8. Non-Infringing Entry Materials. You represent and warrant that you own and are free to grant to Sponsor all rights in and to all Entry Materials granted hereunder; that the Entry Materials do not incorporate any third party materials that would require the consent of a third party, unless such consent has been obtained in writing and submitted to Sponsor; and that all such Entry Materials are original works of authorship that have not been copied, in whole or in part, from any other work and do not violate, misappropriate or infringe any intellectual property or other rights of any other person or entity.
9. General Release. By entering the Contest, you release the Released Parties from any liability whatsoever, and waive any and all causes of action related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of, or inability to use any prize (including, without limitation, claims, costs, injuries, losses, and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty, or other theory.
10. Use of Winner’s Name, Likeness, etc. Except where prohibited by law, entry into the Contest constitutes permission to use each winner’s name, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, each winner may be required to execute an additional written consent to the use of their name, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation.
11. Affidavit & Release. As a condition of being awarded any prize, winners will be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other required legal, regulatory, or tax-related documents.
12. Winner List; Rules Request. For a copy of the winner list, send a stamped, self-addressed, business-size envelope after November 9, 2009 and before November 30, 2009 to Sponsor at the address listed below, Attn: “Costume Photo Contest” Winner List. 14. Miscellaneous. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the State of Michigan. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, cancel, postpone or extend the Contest or any entrant’s participation in the Contest should viruses, bugs, unauthorized human intervention, or other causes beyond Sponsor’s control affect the administration, security, or proper play of the Contest, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, violate any law, rule, or regulation in connection with participation in the Contest, tamper with the operation of the Contest, or engage in any conduct that is detrimental or unfair to Sponsor, the Contest, or any other entrant (in each case as determined in Sponsor’s sole discretion) are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
