so it has never been opened. and is there some sort of legal bond on this app? like if your lying and it's a broken ipod that was just shrink wrapped over a box... would there be punishment for such an act given by facebook such as Ebay or Craigslist does.

It's brand new. Got it with the "Get a free iPod with Mac Purchase". I'm, personally, not certain how Facebook handles false ads, but all I can do is assure you I'm not scamming.

Price will remain the same it's just like getting it from the store brand new, minus the ~$30 I've already knocked off.
